Керуючись пунктом 4 частини 5 статті 41 Закону України «Про публічні закупівлі» «продовження строку дії договору про закупівлю та строку виконання зобов'язань щодо передачі товару, виконання робіт, надання послуг уразі виникнення документально підтверджених об'єктивних обставин, шо спричинили таке продовження, у тому числі обставин непереборної сили, затримки фінансування витрат замовника, за умови що такі зміни не призведуть до збільшення суми, визначеної в договорі про закупівлю» та з урахуванням надзвичайних, невідворотних та об'єктивних обставин для Замовника, що підтверджені листом Торгово-промислової палати України від 28.02.2022 № 2024/02.0-7.1, а саме військовою агресією Російської Федерації проти України, що стало підставою введення воєнного стану із 05 години 30 хвилин 24.02.2022 відповідно до Указу Президента України від 24.02.2022 № 64/2022 «Про введення воєнного стану в Україні» (зі змінами), затвердженого Законом України від 24.02.2022 № 2102-ІХ, які унеможливлюють виконання зобов'язань згідно Договору.
