Згідно п.2 ч.4 ст. 36 Закону України "Про публічні закупівлі" істотні умови договору про закупівлю не можуть змінюватись після його підписання до виконання зобов’язань сторонами в повному обсязі, крім випадків зміни ціни за одиницю товару не більше ніж на 10 відсотків у разі коливання ціни такого товару на ринку, за умови, що зазначена зміна не призведе до збільшення суми, визначеної в договорі.
