Відповідно до пункту 2 частини четвертої статті 36 Закону України «Про публічні закупівлі» істотні умови договору про закупівлю не можуть змінюватися після його підписання до виконання зобов’язань сторонами у повному обсязі, крім випадку зміни ціни за одиницю товару не більш як на 10 відсотків у разі коливання ціни такого товару на ринку за умови, що зазначена зміна не призведе до збільшення суми, визначеної в договорі.
