Керуючись п.3.4., пп.4 п.10.1.,п.11.2. Договору підряду №637 від 11 жовтня 2021 року (далі – Договір) та п.4 ч.5 ст.41 Закону України «Про публічні закупівлі», враховуючи дію надзвичайних, невідворотних та об’єктивних (форс-мажорних) обставин для Замовника, що підтверджено листом Торгово-промислової палати України від 28.02.2022 №2024/02.0-7.1, а саме - військова агресія Російської Федерації проти України та введення воєнного стану із 05 години 30 хвилин 24.02.2022 відповідно до Указу Президента України від 24.02.2022 №64/2022 «Про введення воєнного стану в Україні» (зі змінами), затвердженого Законом України від 24.02.2022 №2102-ІХ, які унеможливлюють виконання/фінансування робіт за Договором, Сторони домовились про продовження строку дії Договору і строку виконання робіт за Договором та вирішили внести зміни до п.3.2., п.11.4. Договору виклавши їх в новій редакції.

Керуючись п.3.4., пп.4 п.10.1., п.11.2. Договору підряду №637 від 11 жовтня 2021 року (далі – Договір) та п.4 ч.5 ст.41 Закону України «Про публічні закупівлі» «продовження строку дії договору про закупівлю та строку виконання зобов’язань щодо передачі товару, виконання робіт, надання послуг у разі виникнення документально підтверджених об’єктивних обставин, що спричинили таке продовження, у тому числі обставин непереборної сили, затримки фінансування витрат замовника, за умови що такі зміни не призведуть до збільшення суми, визначеної в договорі про закупівлю», у зв’язку з відсутністю фінансування, Сторони вирішили продовжити строк дії Договору та строк виконання зобов’язань щодо виконання робіт, внести зміни в п. 3.2., п.11.4. Договору та викласти ці пункти в новій редакції.
