У зв’язку із військовою агресією Російської Федерації проти України, що стала підставою введення воєнного стану в Україні із 05 годин 30 хвилин 24 лютого 2022 року відповідно до Указу Президента України від 24 лютого 2022 року № 64/2022 «Про введення воєнного стану в Україні» із останніми змінами внесеними згідно з Указом Президента України № 757/2022 від 07.11.2022 «Про продовження строку дії воєнного стану в Україні» (які знаходиться за посиланням: https://zakon.rada.gov.ua/laws/show/64/2022#Text та https://zakon.rada.gov.ua/laws/show/757/2022#n2), виникли форс-мажорні обставини (обставини непереборної сили), зокрема: надзвичайних, невідворотних та об’єктивних обставин для суб’єктів господарювання, що підтверджено листом Торгово-промислової палати України від 28.02.2022 № 2024/02.0-7.1 (додається), та які також спричинили до затримки фінансування витрат замовника (Кошторис асигнувань додається). Вартість робіт, виконаних та профінансованих Замовником згідно основного договору у 2018-2022 р становить 4046343,90 грн. з ПДВ. Вартість робіт (вартість річного обсягу робіт), які підлягають виконанню до завершення по Договору, що становить 32774,10 грн у т.ч. ПДВ Враховуючи наведене, керуючись розділом 9, п. 10.1, пп. 4 п. 11 розділу 11 (Істотні умови договору про закупівлю не можуть змінюватися після його підписання до виконання зобов'язань сторонами у повному обсязі, крім випадків продовження строку дії договору та виконання зобов’язань щодо передання товару, виконання робіт, надання послуг у разі виникнення документально підтверджених об’єктивних обставин, що спричинили таке продовження, у тому числі непереборної сили, затримки фінансування витрат замовника, за умови, що такі зміни не призведуть до збільшення суми, визначеної в договорі) та ін. умов Договору № 402-к від 09.10.2018р. та Закону України «Про публічні закупівлі», Сторони домовились: 1.1. Продовжити строк виконання робіт до 31.12.2023 р. шляхом внесення змін в Графік виконання робіт (Додаток №1 до Договору № 402-к від 09.10.2018р), та останній викласти в новій редакції (Додаток 1 до договору додається, що є невід’ємною основного Договору № 402-к від 09.10.2018р.)
