Керуючись положеннями Закону України «Про ринок електричної енергії», відповідно до п. 2 ч. 5 ст. 41 Закону України «Про публічні закупівлі» від 25.12.2015 № 922-VIII (із змінами у новій редакції від 19.04.2020, підстава – 114-IX) (далі - Закон) та згідно з п.13.2 розділу 13 «Строк дії Договору та інші умови» п. 13.2. 2) Договору (збільшення ціни за одиницю товару до 10 відсотків можливе пропорційно збільшенню ціни такого товару на ринку у разі коливання ціни такого товару на ринку за умови, що така зміна не призведе до збільшення суми, визначеної в договорі про закупівлю, - не частіше ніж один раз на 90 днів з моменту підписання договору про закупівлю. Обмеження щодо строків зміни ціни за одиницю товару не застосовується у випадках зміни умов договору про закупівлю бензину та дизельного пального, газу та електричної енергії), у зв’язку з коливанням ціни природного газу на ринку України (згідно довідки Державного підприємства "Державний Інформаційно-Аналітичний центр моніторингу зовнішніх товарних ринків" № 121/68 від 26.11.2020, а також враховуючи прийняття постанови НКРЕКП від 04.11.2020 № 1998, яка набирає чинності з 01.12.2020) Сторони дійшли спільної згоди внести зміни до Договору, а саме: з 01.12.2020 ціна електричної енергії, що постачається за договором від 30.07.2020 № ЕТГ, складе 2,7020 грн. з ПДВ за 1 кВт/год.
