Керуючись п.1 ч.5 ст. 41 Закону України «Про публічні закупівлі» Сторони дійшли згоди зменшити обсяги закупівлі передбачені до 31.01.2023р. у зв’язку з урахуванням фактичного обсягу видатків замовника станом на 29.12.2022 та викласти Пункт 5.1 Договору в попередній редакції:
«5.1. Загальна ціна (сума) Договору становить 6929347,58 грн, в т.ч. ПДВ 1154891,26 грн.
З них:
Власний бюджет (кошти від господарської діяльності підприємства) – 388677,60 грн.
Місцевий бюджет – 6540669,98 грн.
Очікуваний обсяг постачання електричної енергії на період 2022 рік становить 1471895 кВТ*год».

Керуючись п.4 ч.5 та ч.6 ст. 41 Закону України «Про публічні закупівлі» у зв’язку з необхідністю проведення Споживачем на початку 2023 року тендерної процедури закупівлі електричної енергії, з метою безперервного постачання електричної енергії, та керуючись пунктами 5.5., 13.9. Договору №6 про постачання електричної енергії споживачу від 13.01.2022 уклали цю додаткову угоду про наступне:
1. Продовжити дію договору №6 про постачання електричної енергії споживачу від 13.01.2022 по 31 січня 2023 року в частині постачання електричної енергії, а в частині розрахунків до їх повного виконання та внести зміни до пункту 13.1 Договору, виклавши в наступній редакції:
«13.1. Договір вважається укладеним та дійсним з моменту його підписання уповноваженими представниками Сторін та скріплення їх підпису печатками (у разі їх наявності) та набуває чинності з 13.01.2022 року і діє по 31.01.2023 року, а в частині проведення розрахунків – до їх повного здійснення.»
2. Загальна вартість товару, що буде закуплений в період з 01 січня 2023 року по 31 січня 2023 року, визначається окремою додатковою угодою між Сторонами та не може перевищувати 20% суми Договору №6 від 13.01.2022 року.
3. Конкретний обсяг товару, що буде закуплений в період з 01 січня 2023 року по 31 січня 2023 року, визначається окремою додатковою угодою між Сторонами після затвердження кошторису Споживача.
