Керуючись п. 12.5 Договору Сторони дійшли взаємної згоди:
1. Виключити з пункту 12.4 Договору абзац восьмий, а саме: «Зміни встановленого згідно із законодавством органами державної статистики індексу споживчих цін, зміни курсу іноземної валюти, зміни біржових котирувань або показників Platts, ARGUS регульованих цін (тарифів) і нормативів, що застосовуються в договорі про закупівлю, у разі встановлення в договорі про закупівлю порядку зміни ціни».
2. Виключити пункт 1.2.1. з Додатку № 2 «Комерційна пропозиція» до Договору.
3. В зв’язку з чим пункти 1.2.2. та 1.2.3. Додатку № 2 «Комерційна пропозиція» до Договору вважати пунктами 1.2.1. та 1.2.2.
