Note:
Відповідно до положень Цивільного кодексу України та Господарського кодексу України термін відстрочки платежу не відноситься до істотних умов договору. Відповідно до Бюджетного кодексу України ст. 3 ч. 1 бюджетний період для всіх бюджетів, що складають бюджетну систему України, становить один календарний рік, який починається 1 січня кожного року і закінчується 31 грудня того ж року. В зв’язку з наданням підрядником календарного графіку виконання робіт по об’єкту, що є невід’ємною частиною договору, де розписані роботи до жовтня місяця 2020 року, що не уможливлює здійснити оплату з відстрочкою платежу до 120 календарних днів (пункт 2.2 договору).
Виходячи з вище викладеного сторони дійшли згоди пункт 2.2 викласти в новій редакції.
