У зв’язку зі збільшенням середньої ринкової ціни на Товар (відповідно до експертних висновків №О-338 від 21.09.2022, 30.09.2022 №О-376) керуючись Розділом ІІІ. «Ціна та сума договору» Договору № 7047 від 07.09.2022 року, п.2 ч.5 ст. 41 ЗУ «Про публічні закупівлі», Сторони дійшли згоди про збільшення ціни за одиницю товару та відповідно зменшення загального обсягу закупівлі у відповідності до викладеної в новій редакції Специфікації (Додаток №1 до Договору № 7047 від 07.09.2022 року).

Керуючись підп.8 п.19 Особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України «Про публічні закупівлі» на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування, ч.6 ст.41 Закону України «Про публічні закупівлі» та умовами діючого договору, а також з урахуванням положень додаткової угоди № 2 від 30.12.2022р. до Договору, Сторони прийшли до згоди продовжити дію Договору на строк, достатній для проведення процедури закупівлі на початку 2023 року, в обсязі, що не перевищує 20 відсотків суми, визначеної в початковому Договорі про закупівлю, укладеному в попередньому році, якщо видатки на досягнення цієї цілі затверджено в установленому порядку.
