При розміщені оголошення № UA-2017-12-06-001268-а «відкриті торги» на закупівлю природного газу секретарем було допущено технічну (механічну) помилку, а саме в графі «Строк поставки товарів, виконання робіт чи надання послуг» було вказано «від 01 січня 2018 до 30 листопада 2018», а повинно бути «від 01 січня 2018 до 31 грудня 2018» , проте дана помилка була виявлена лише після оприлюднення повідомлення про намір укласти договір. В тендерній документації в графі «Строк поставки товарів, виконання робіт чи надання послуг» зазначається до 31.12.2018 року також в проекті договору в п. 3. 13. Строк (термін) поставки товару: до 31.12.2018 року., а тому зазначення дати 30 листопада 2018 року є технічною (механічною) помилкою. Секретар тендерного комітету зазначила, що Закон України “Про публічні закупівлі” (далі - Закон) установлює правові та економічні засади здійснення закупівель товарів, робіт і послуг для забезпечення потреб держави та територіальної громади. Відповідно до пункту 6 і пункту 11 частини першої статті 8 та статті 14 Закону наказом Мінекономрозвитку від 18.03.2016 No 477 затверджено Порядок розміщення інформації про публічні закупівлі (далі –Порядок), що визначає процедуру розміщення інформації про публічні закупівлі, яка оприлюднюється на веб -порталі Уповноваженого органу з питань закупівель у складі електронної системи закупівель (далі –система). Згідно з пунктом 3 Порядку розміщення інформації в системі здійснюється замовником шляхом її внесення та заповнення в електронному вигляді через автоматизоване робоче місце замовника. Розміщенням/оприлюдненням інформації вважається її наявність в системі в інтерактивному режимі реального часу (пункт 10 Порядку). При цьому Порядок не містить механізму виправлення технічних (механічних) помилок, допущених замовником при заповненні форм документів у сфері публічних закупівель. Ураховуючи зазначене та виходячи зі змісту статті 11 Закону, після оприлюднення відповідної інформації, тендерний комітет може прийняти рішення про виправлення таких помилок, шляхом оформлення відповідного протоколу, який підписується всіма членами комітету, присутніми на його засіданні. Відповідно до вищенаведеного тендерним комітетом було прийняте рішення: «Виправити дану помилку та викласти в новій редакції даний пункт, а саме: «Строк поставки товарів, виконання робіт чи надання послуг» «від 01 січня 2018 до 31 грудня 2018» після укладення договору на постачання природного газу та його оприлюднення.
