Сторони керуючись частинами першою та другою статті 632 Цивільного кодексу України, частиною п’ятою статті 41 Закону України «Про публічні закупівлі», підпунктів 5.1, 5.2 розділу 5 Договору, підпункту 13.2 розділу 13 Договору та у зв’язку з коливанням ціни електричної енергії на ринку, що документально підтверджується експертним висновком Харківської торгово-промислової палати № 325/21 від 10.02.2021 року, відповідно до якого середньозважена ціна купівлі-продажу електроенергії на майданчику РДН (ринок «на добу наперед») у торговій зоні ОЕС України (об’єднаної енергетичної системи України) за першу декаду лютого (01.02-10.02) 2021 року у порівнянні з січнем (01.01-31.01) січня 2021 року зросла на 16,15 %, уклали дану Додаткову угоду, про збільшення ціни за одиницю товару не більше ніж на 10 відсотків без збільшення ціни Договору
