Відповідно до п.2 ч.5 ст. 41 Закону України "Про публічні закупівлі" - збільшення ціни за одиницю товару до 10 відсотків пропорційно збільшенню ціни такого товару на ринку у разі коливання ціни такого товару на ринку за умови, що така зміна не призведе до збільшення суми, визначеної в договорі про закупівлю, - не частіше ніж один раз на 90 днів з моменту підписання договору про закупівлю. Обмеження щодо строків зміни ціни за одиницю товару не застосовується у випадках зміни умов договору про закупівлю бензину та дизельного пального, газу та електричної енергії. Станом на грудень 2021 року вартість 1 кВт*год становить 3,76 грн. з ПДВ. Очікуваний обсяг закупівлі 163754,000 кВт год.

Note:
Керуючись пунктами 1 та 2 частини 5 статті 41 Закону України "Про публічні закупівлі", Сторони дійшли згоди, що ціна за одиницю товару - 4,13 грн. з ПДВ. Обсяг закупівлі 163662 кВт год. Сума договору 598495,56 грн. з ПДВ. Керуючись частиною 6 статті 41 Закону України "Про публічні закупівлі", та згідно до п.14.2 Договору Сторони дійшли згодиподовжити дію договору на строк, достатній для проведення процедури закупівлі на початку 2022 року, та подовжити дію договору до 28 лютого 2022 року.

Зважаючи на необхідність проведення Споживачем на початку 2022 року процедури закупівлі електричної енергії, керуючись пунктом 2 частини 5 частиною 6 статті 41 Закону України "Про публічні закупівлі" від 25 грудня 2015 року №922 - VIII, ст. 188 Господарського кодексу України, пунктами 14.2.2 та 14.2.8. розділу 4 Договору про постачання електричної енергії споживачу №21/10-05/89 від 23.10.2021 р. Сторони дійшли взаємної згоди укласти цю Додаткову угоду до Договору.
