Керуючись п. 1 ч. 5 статті 41 Закону України «Про публічні закупівлі» від 25.12.2015 №922-VIII (зі змінами) та п. п. 1. п. 11.2. Договору Сторони домовились зменшити загальну суму Договору на 87 333,60 грн. та зменшити обсяги закупівлі на 7 445,32 л. та затвердити асортимент, кількість та ціни на товар у Специфікації (Додаток 1), яка є невід’ємною частиною цієї Додаткової угоди № 7.

Керуючись частиною 5 статті 36 Закону України «Про публічні закупівлі» від 08.02.2020 №922-VIII та пунктом 11.4 Договору №015 від 11 березня 2020 року Сторони дійшли взаємної згоди укласти Додаткову угоду, якою продовжують дію Договору на строк достатній для проведення процедури закупівлі на початку наступного року, в обсязі, що не перевищує 20 відсотків суми, визначеної в Договорі.

Сторони дійшли згоди, що згідно цієї Додаткової угоди, з 01.01.2021 року до 31.12.2021 року, Учасник поставлятиме Замовнику пропан скраплений.
Сторони вирішили, що загальна вартість цієї Додаткової угоди без ПДВ складає 11 844,40 грн. (одинадцять тисяч вісімсот сорок чотири гривні 40 копійок), в т.ч. ПДВ 2 368,88 грн. Всього з ПДВ 14 213,28 грн. (чотирнадцять тисяч двісті тринадцять гривень 28 копійок).
Ця Додаткова угода діє до 31.03.2021 року та згідно ч. 3 ст. 631 ЦКУ розповсюджує свою дію на правовідносини, що склалися між сторонами з 01.01.2021 року, в частині постачання пропану скрапленого, а в частині розрахунків до повного виконання зобов’язань.
Випадки для внесення змін до істотних умов договору: відповідно до частини 5 статті 36 Закону України «Про публічні закупівлі» від 08.02.2020 №922-VIII дія договору про закупівлю може продовжуватися на строк, достатній для проведення процедури закупівлі на початку наступного року, в обсязі, що не перевищує 20 відсотків суми, визначеної в договорі, укладеному в попередньому році, якщо видатки на цю мету затверджено в установленому порядку.
