Згідно ст.36 ч.5, п.8 ч.4 Закону України "Про публічні закупівлі", дія договору про закупівлю може продовжуватися на строк, достатній для проведення процедури закупівлі на початку наступного року, в обсязі, що не перевищує 20 відсотків суми, визначеної в договорі, укладеному в попередньому році, якщо видатки на цю мету затверджено в установленому порядку. На момент укладання додаткової угоди №8 від 18.12.2017 року замовник не мав затвердженого кошторису, враховуючи це було прийняте рішення продовжити лише строк дії договору до 28.02.2018 р.. У зв’язку із затвердженням кошторису, необхідно укласти додаткову угоду №9 до Договору поставки природного газу в частині визначення конкретної 20-відсоткової суми, визначеної в договорі, та відповідно обсягів закупівлі природного газу. Враховуючи вказане, сума Договору №442 (17) від 07.02.2017 про поставку природного газу збільшується на 235931,00 грн., що в загальному буде становити 1415586,00 грн. (один мільйон чотириста п’ятнадцять тисяч п’ятсот вісімдесят шість грн.00 коп.) з ПДВ. Об’єм газу по Договору збільшується на 23831,414 куб. м. та становить 144 951,605 куб. м. Про що укладена додаткова угода №9 від 16.01.2018 р. Відповідно до п.2 ч.4 ст.36 Закону України "Про публічні закупівлі", може змінюватися ціна за одиницю товару не більше ніж на 10 відсотків у разі коливання ціни такого товару на ринку за умови, що зазначена зміна не призведе до збільшення суми, визначеної в договорі. Відповідно до листа вих. № 23/10 від 11.01.2018 р., ТОВ “Ас», просить, шляхом укладення додаткової угоди, збільшити ціну за одиницю товару (газу) на 8%, який їх підприємство постачає в межах підписаного Договору№442 (17) про закупівлю товарів за державні кошти від 07.02.2017 р. згідно проведених торгів. Аргументує свої вимоги тим, що збільшилася у січні 2018 року вартість природного газу на ринку, що підтверджується прейскурантами, розміщеними на сайтах НАК «Нафтогаз України», Експертним висновком №О-5/03 від 03.01.2018 р. Черкаської торгово-промислової палати. Враховуючи вказане, сума Договору №442 (17) від 07.02.2017 про поставку природного газу залишається незмінною та буде становити 1415586,00 грн. (один мільйон чотириста п’ятнадцять тисяч п’ятсот вісімдесят шість грн.00 коп.) з ПДВ. Об’єм газу по Договору зменшується на 1777,666 куб. м. та становить 143 173,939 куб. м. Про що укладена додаткова угода №10 від 16.01.2018 р.
