Керуючись частиною 5 статті 36 "Основні вимоги до договору про закупівлю" розділу VII закупівлю" Закону України"про публічні закупівлі" від 25.12.2015р., №922-VIII, відповідно до якої дія договору про закупівлю може продовжуватися на строк, достатній для проведення процедури закупівлі на початку наступного року, в обсязі, що не перевищує 20 % суми, визначеної в договорі, укладеному в попередньому році, якщо видатки на цю мету затверджено у встановленому порядку, а також згідно з частиною 1 статті 23 Бюджетного кодексу України, відповідно до якої будь-які бюджетні зобов'язання та платежі з бюджету здійснюються лише за наявності відповідного бюджетного призначення, якщо інше не передбачено законом про Державний бюджет України
