З урахуванням листа ПОСТАЧАЛЬНИКА №3/09 від 09.09.2022 р., пунктів 10.3, 15.7 Договору Сторони дійшли згоди щодо збільшення ціни за одиницю продукції без збільшення суми, визначеної в Договорі, при цьому зменшити обсяг закупівлі продукції. Примітка: закупівля здійснювалась відповідно до постанови Кабінету Міністрів України від 28 лютого 2022 р. № 169 у редакції, чинній на момент укладання договору про закупівлю. Відповідно до абзацу першого підпункту 1 пункту 1 Постанови в умовах воєнного стану оборонні та публічні закупівлі товарів, робіт і послуг здійснюються без застосування процедур закупівель та спрощених закупівель, визначених Законами України “Про публічні закупівлі” та “Про оборонні закупівлі”. Зазначена підстава обрана у зв'язку із відсутністю в електронній системі підстави, яка відповідала б предмету додаткової угоди.
