Керуючись пунктом 2 частини 5 статті 41 Закону України «Про публічні закупівлі» від 25 грудня 2015 року № 922 – VIII, ст. 188 Господарського кодексу України, пунктами 5.2, 5.3 розділу 5 Договору № 8/08 про постачання електричної енергії споживачу від 18.08.2021 р. (далі – Договір), та враховуючи, що відбулось зростання ціни електричної енергії на ринку, - змінилася ціна за одиницю електричної енергії. Взявши до уваги, що зазначена ціна не призведе до збільшення суми, визначеної у Договорі, сторони домовились внести зміни до Договору.4. Дія цієї Додаткової угоди розповсюджується на відносини, які виникли між сторонами з 01.10.2021 р. у відповідності до ч.3 ст. 631 Цивільного кодексу України.

Керуючись ст. 188 Господарського кодексу України, пунктами 5.2, 5.3 розділу 5 Договору № 8/08 про постачання електричної енергії споживачу від 18.08.2021 р. (далі – Договір), та враховуючи, що відбулось зростання ціни електричної енергії на ринку, - змінилася ціна за одиницю електричної енергії. У зв’язку зі зменшенням фінансування на оплату електроенергії Сторони домовились внести зміни до Договору, а саме:
Внести зміни до пункту 5.1. Договору, та викласти його в наступній редакції:
«п.5.1. Ціна договору становить 25662,07 грн. (двадцять п’ять тисяч шістсот шістдесят дві гривні 07 коп.) гривень, в тому числі ПДВ (20%) – 4277 грн. 01 коп. (чотири тисячі двісті сімдесят сім гривень 01 коп.) в т.ч. за рахунок бюджетних призначень - 17481 грн. 97 коп. ( сімнадцять тисяч чотириста шісімдесят одна грн. 97 коп. ) в т.ч. ПДВ (20%) - 2913 грн. 66 коп. ( дві тисячі дев’ятсот тринадцять грн. 66 коп.), за рахунок відшкодування за сумісне використання лічильника КПСМНЗ «Харківська школа мистецтв для підлітків та дорослих» - 8180 грн. 10 коп. (вісім тисяч сто вісімдесят одна грн. 10 коп.), в т.ч. ПДВ ( 20%) - 1363 грн. 35 коп.(одна тисяча триста шістдесят три грн.35 коп.) – (код за ДК 021:2015-09310000-5-електрична енергія).»;викласти Додаток № 4 до Договору «Відомості фізичних величин електроенергії на 2021 рік» в новій редакції.
