На підставі ст. 36 ч.4 п.2 та п.1.Закону України " Про Публічні закупівлі" "Істотні умови договору про закупівлю не можуть змінюватися після його підписання, крім випадків:
1) Зменшення обсягів закупівлі, зокрема з урахуванням фактичних видатків замовника;
2) зміни ціни за одиницю товару не більше ніж на 10 відсотків у разі коливання ціни такого товару на ринку, за умови, що зазначена ціна не призведе до збільшення суми, визначеної в договорі"
В результаті вивченн та аналізу кон'юктури цін на рибу на ринку Кіровоградської області, Сторони узгодили змінити ціну за одиницю товару у бік збільшення.

Відповідно до Закону України "Про публічні закупівлі", відповідно до п.4, ч.2 ст.36 та враховуючи коливання ринкової ціни на рибу, враховуючи Експертний висновок Кіровоградської Торгово-Промислової Палати №В-334/1 від 05.04.2018 року , наданого ФОП Хомич В.М, збільшено ціну за 1 кг риби на 10%.
