Внесення змін згідно п.3 ч.4 ст.36 ЗУ "Про публічні закупівлі" - покращення якості предмета закупівлі за умови, що таке покращення не призведе до збільшення суми, визначеної в договорі, а саме:пункт 1.1. розділу І Предмет договору викласти в наступній редакції: "1.1 Теплопостачальна організація зобов"язується у 2017 році надавати Споживачу Пару, гарячу воду та пов"язану продукцію, а Споживач - прийняти і оплатити такі послуги". 2. Сторони керуючись положеннями пункту 1 та 7 частини 4 статті 36 ЗУ №922 "Про публічні закупівлі", п. 3.2. Договору дійшли до взаємної згоди, щодо зменшення ціни Договору відповідно до реального фінансування. Пункт 3.1. Договору викласти в наступній редакції : Ціна Договору становить 1213920.04 грн ( в т.р. ПДВ). 3. Обсяги постачання викласти в новій редакції.

Усі інші положення цього Договору, зміну яких не передбачено цією Угодою, залишаються незмінними і обов"язковими до виконання Сторонами.

Відповідно до положень статті 36 ЗУ "Про публічні закупівлі" Сторони домовились: 1. Збільшити обсяги теплопостачання на 85,4789 Гкал та ціну Договору на 170 752,60 грн. в тому числі ПДВ 20% - 28 458, 77 грн. , що не перевищує 20% суми , визначеної в договорі, укладеному в попередньому році (термін дії Договору подовжено до 31 березня 2018р. дод. угодою № 4 від 31.12.2017р.) якщо видатки на цю мету затверджено в установленому порядку, вимог ч. 5 ст. 36 ЗУ "Про публічні закупівлі". 2. Додаток №1 Обсяги постачання теплової енергії до Договору, викласти в новій редакції.
