Note:
Керуючись п. 4 ч. 4 ст. 36 Закону України "Про публічні закупівлі" та враховуючи лист головного розпорядника коштів від 18.09.2020 № 053-14687 про затримку фінансування, пунктами 4.3, 20.1, 20.2 Договору, сторони дійшли згоди укласти додаткову угоду про таке:
1. Пункт 4.2 Договору викласти в новій редакції:
4.2. Обсяги фінансування робіт на березень – листопад 2020 року, відповідно до бюджетних призначень м. Києва, становлять: 163 251 600,00 грн.
2. Додаток 2 до Договору – «Календарний план виконання робіт» та Додаток 4 до Договору «Лінійний графік виконання робіт» викласти в новій редакції.
3. Сторони погодили внести зміни в п. 19.1 Договору, виклавши його в наступній редакції:
«19.1. Цей Договір набуває чинності з моменту його підписання та діє до 31 грудня 2021 року, але в будь-якому випадку до повного виконання Сторонами своїх зобов’язань за цим Договором. В частині виконання гарантійних зобов’язань та відповідальності за їх невиконання умови Договору залишаються дійсними впродовж гарантійних строків.».

по рахунку «UA508201720344381002100042606» - 106 695 000,00 грн. (сто шість мільйонів шістсот дев’яносто п’ять тисяч грн. 00 коп.), у тому числі ПДВ 20% – 17 782 500,00 грн.;
по рахунку «UA208201720344311004107042606» - 143 841 650,00 грн. (сто сорок три мільйони вісімсот сорок одна тисяча шістсот п’ятдесят грн. 00 коп.), у тому числі ПДВ 20% – 23 973 608,33 грн.».
2. Додаток 2 до Договору – «Календарний план виконання робіт» та Додаток 4 до Договору «Лінійний графік виконання робіт» викласти в новій редакції, що додаються та які є невід’ємною частиною цієї Угоди та Договору.

«4.1. Вартість фактично виконаних та оплачених робіт станом на 01.01.2020 року становить: 70 484 127,80 грн. (сімдесят мільйонів чотириста вісімдесят чотири тисячі сто двадцять сім грн. 80 коп.), у тому числі ПДВ 20% – 11 747 354,63 грн.
4.2. Вартість фактично виконаних та оплачених робіт у 2020 році становить: 250 536 649,99 грн. (двісті п’ятдесят мільйонів п’ятсот тридцять шість тисяч шістсот сорок дев’ять гривень 99 копійок), у тому числі ПДВ 20 % – 41 756 108,33 грн.».
4.3. Обсяги фінансування робіт на 2021 рік, відповідно до адресного переліку об’єктів для виконання робіт з капітального ремонту в межах бюджетних призначень на 2021 рік, затверджених Департаменту транспортної інфраструктури виконавчого органу Київської міської ради (Київської міської державної адміністрації), становлять: 269 195 722,21 грн. (двісті шістдесят дев’ять мільйонів сто дев’яносто п’ять тисяч сімсот двадцять дві гривні 21 копійка), у тому числі ПДВ 20 % – 44 865 953,71 грн., але можуть бути змінені у разі коригування обсягів бюджетного фінансування на зазначені роботи.
4.4. Зобов’язання за Договором виникають в межах затверджених бюджетних асигнувань на відповідний бюджетний період, про що Сторонами укладається відповідна додаткова угода до цього Договору. Оплата виконаних робіт здійснюється в межах фактичного фінансування.
4.5. Фінансування робіт, визначених цим Договором, здійснюється за рахунок бюджетних коштів.».
3. Абзац 2 пункту 5.1 Договору викласти в наступній редакції:
«Відповідно до постанов Кабінету Міністрів України від 04.12.2019 № 1070 «Деякі питання здійснення розпорядниками (одержувачами) бюджетних коштів попередньої оплати товарів, робіт і послуг, що закуповуються за бюджетні кошти» та від 27.12.2001 № 1764 «Про затвердження Порядку державного фінансування капітального будівництва» (з урахуванням нормативно-правових актів щодо карантину, встановленого Кабінетом Міністрів України), згідно з належним чином оформленого рішення головного розпорядника бюджетних коштів, Замовник може надати Виконавцю аванс.».
4. Після підпункту 6.4.16 пункту 6.4 Розділу VI Договору доповнити новим підпунктом такого змісту:
«6.4.17. Після завершення робіт/частини робіт із встановлення опор зовнішнього освітлення та/або опор контактної мережі типу ОКМ, за свій рахунок замовити у спеціалізованій сертифікованій організації Експертну оцінку (звіт) відповідності нанесеного захисного покриття на такі опори методу, передбаченому технічними умовами та затверджетними проектними рішеннями. Врахувати, що без надання зазначеної Експерної оцінки (звіту) Акти приймання виконаних будівельних робіт (ф. КБ-2в) повертаються Замовником Виконавцю без підпису.».
У зв’язку з цим підпункти 6.4.17, 6.4.18, 6.4.19 Договору вважати відповідно підпунктами 6.4.18, 6.4.19, 6.4.20.
5. Додаток 2 до Договору – «Календарний план виконання робіт» та Додаток 4 до Договору «Лінійний графік виконання робіт» викласти в новій редакції
