Керуючись пунктом 11 Договору № 0906-9 від 09 червня 2022 року (далі-«Договір») та пунктом 4 частини 5 статті 41 Закону України «Про публічні закупівлі» (далі – Закон) «продовження строку дії договору про закупівлю та строку виконання зобов`язань щодо передачі товару , виконання робіт , надання послуг у разі виникнення документального підтвердження об`єктивних обставин , що спричинили таке продовження , у тому числі обставин непереборної сили, затримки фінансування витрат замовника, за умови що такі зміни не призведуть до збільшення суми, визначеної в договорі про закупівлю» та з урахуванням надзвичайних, невідворотних та об`єктивних обставин для Замовника, що підтверджені листом Торгово-промислової палати України від 28.02.2022 року №2024/02.0-7.1. а саме військовою агресією Російської Федерації проти України, що стало підставою введення воєнного стану із 05 годин 30 хвилин 24.02.2022 відповідно до Указу Президента України від 24.02.2022 №64/2022 «Про введення воєнного стану в Україні» (зі змінами) , затвердженого Законом України від 24.02.2022 №2102-ІХ які унеможливлюють виконання зобов`язань згідно з пунктом 11 Договору.
