Відповідно до п.7 ч.5 ст.41 Закону України "Про публічні закупівлі" істотні умови договору про закупівлю не можуть змінюватися після його підписання до виконання зобов’язань сторонами в повному обсязі, крім випадків:... зміни встановленого згідно із законодавством органами державної статистики індексу споживчих цін, зміни курсу іноземної валюти, зміни біржових котирувань або показників Platts, ARGUS регульованих цін (тарифів) і нормативів, що застосовуються в договорі про закупівлю, у разі встановлення в договорі про закупівлю порядку зміни ціни. У зв'язку із тим, що 01.01.2022 змінилися регульовані складові на електричну енергію, а саме : тариф на послуги оператора передачі (постанова НКРЕКП № 2454 від 01.12.2021р)
