Враховуючи прийняття Постанови НКРЕКП №1343 від 11.07.2020р., якою встановлено тариф на послуги з розподілу електричної енергії 2 клас напруги – 692,46 грн/МВт·год (без урахування податку на додану вартість).
Відповідно до п. 3 ст. 631 Цивільного кодексу України Сторони прийшли до взаємної згоди, що умови п.1. цієї додаткової угоди до договору застосовуються до відносин між ними з 01.09.2020 року, в т.ч. розрахунках.

3. Сторони, керуючись положеннями Закону України «Про ринок електричної енергії», відповідно частини п’ятої Розділу Х ПРИКІНЦЕВІ ТА ПЕРЕХІДНІ ПОЛОЖЕННЯ Закону України «Про публічні закупівлі» від 25.12.2015р. №922 (у редакції Закону № 114-ІХ від 19.09.2019р.), на підставі частини п’ятої статті 36 Закону України «Про публічні закупівлі» від 25.12.2015р. №922 (у редакції Закону, що діяв до 19.04.2020р.), пп.7 п.12.1 розділу 12 «Інші умови» Договору, врахували прийняття Постанови НКРЕКП №2374 від 09.12.2020р., якою встановлено тариф на послуги з розподілу електричної енергії 2 клас напруги – 890,28 грн/МВт·год (без урахування податку на додану вартість).
