Збільшення ціни за одиницю товару до 10 відсотків пропорційно збільшенню ціни такого товару на ринку у разі коливання ціни такого товару на ринку за умови, що така зміна не призведе до збільшення суми, визначеної в договорі про закупівлю, - не частіше ніж один раз на 90 днів з моменту підписання договору про закупівлю. Обмеження щодо строків зміни ціни за одиницю товару не застосовується у випадках зміни умов договору про закупівлю бензину та дизельного пального, газу та електричної енергії згідно ч.2 п.5 ст.41 Закону України "Про публічні закупівлі".

Відповідно до п. 1 ч. 5 ст. 41 Закону України «Про публічні закупівлі» істотні умови договору про закупівлю можуть змінюватися після його підписання у випадку зменшення обсягів закупівлі, зокрема з урахуванням фактичного обсягу видатків замовника. Необхідність внесення таких змін обґрунтовується зменшенням обсягів закупівлі у зв’язку з введенням карантину на усій території України з 12.03.2020 року та забороною відвідування закладів освіти її здобувачами (постанова Кабінет Міністрів України, від 11 березня 2020 р. № 211).
