Згідно з п.2 ч.5 ст. 41 Закону України «Про публічні закупівлі» істотні умови договору про закупівлю не можуть змінюватися після його підписання, крім випадків: збільшення ціни за одиницю товару до 10% відсотків пропорційно збільшенню ціни такого товару на ринку у разі коливання ціни такого товару на ринку за умови, що така зміна не призведе до збільшення суми, визначеної в договорі про закупівлю – не частіше ніж один раз на 90 днів з моменту підписання договору про закупівлю. Дана умова має силу лише за умов поставки Учасником 50% товару, з обов’язковим урахуванням вимог щодо збільшення ціни не раніше ніж 90 днів з моменту підписання договору про закупівлю.
