Note:
1. Керуючись ст.7 Договору № 350942 від 10.01.2020 року, ч 5 ст. 36 Закону України «Про публічні закупівлі» (далі-Закон) Сторони домовились продовжити дію Договору на строк, достатній для проведення процедури закупівлі на початку 2021 року в обсязі, що не перевищує 20 відсотків суми, визначеної в Договорі, відповідно п. 7 Договору викладено в редакції:
«7. Цей Договір набуває чинності з дати його підписання уповноваженими представниками Сторін та скріплення їх підписів печатками (за наявності) Сторін і діє в частині постачання електричної енергії з 10.01. 2021 року до 31.01.2021 року, а в частині проведення розрахунків – до їх повного здійснення»
2. З урахуванням ст. 48 Бюджетного кодексу України зобов’язання Замовника щодо оплати поставлених товарів (наданих послуг) виникають виключно при наявності та в обсягах відповідного бюджетного асигнування, завантаженого для замовника на фінансування закупівлі протягом 2021 року. Після затвердження у встановленому порядку бюджетних асигнувань для Замовника на фінансування закупівлі протягом 2021 року Сторони уточнюють обсяги взяття взаємних зобов’язань в частині поставки товарів (надання послуг) та їх оплати в межах строку дії Договору (з урахуванням цієї Додаткової угоди) та шляхом укладення додаткової угоди.
