Керуючись пунктом 4, частини 5, статті 41 Закону України «Про публічні закупівлі», пунктами 11.1; 12.1.3 Договору, Сторони дійшли згоди продовжити строк дії Договору № 76 від 06.09.2021 р. та строк виконання зобов’язань у зв’язку з виникненням документально підтверджених об’єктивних обставин, що спричинили таке продовження, а саме: відповідно до листа Тернопільської міської ради (від 23.12.2021 №640), на даному об’єкті не завершені роботи з виконання технічних умов від КП «ТЕРНОПІЛЬВОДОКАНАЛ»(Замовник) щодо влаштування каналізаційної мережі підрядником ТОВ «ТЕРНОПІЛЬБУД», що не дало технологічної можливості ТОВ "ТЕХНО-БУД-ЦЕНТР" виконувати роботи відповідно до проєктної – кошторисної документації.
