Керуючись постановою КМУ від 27 грудня 2001 р. № 1764 «Про затвердження Порядку державного фінансування капітального будівництва» (зі змінами та доповненнями), та постановою КМУ від 23 квітня 2014 р. № 117 «Про здійснення попередньої оплати товарів, робіт і послуг, що закуповуються за бюджетні кошти» (зі змінами та доповненнями) внести зміни в п. 11.9 Договору та викласти його в наступній редакції: «п. 11.9 Замовник може здійснювати попередню оплату (виплату авансу) в розмірі до 60% вартості зазначених робіт за договором на строк не більше ніж 6 місяців. Підрядник зобов'язується використати одержаний аванс на придбання і постачання необхідних для виконання робіт матеріалів, конструкцій, виробів протягом шести місяців після одержання авансу. По закінченню шестимісячного терміну, Підрядник надає підтверджуючі документи щодо використання авансу. У разі не надання таких документів, Підрядник повертає Замовнику не використану суму авансу.»

У зв’язку з внесенням змін до постанови КМУ від 23 квітня 2014 р. № 117 «Про здійснення попередньої оплати товарів, робіт і послуг, що закуповуються за бюджетні кошти» (зі змінами та доповненнями), а саме: попередня оплата розпорядниками (одержувачами) бюджетних коштів за капітальними видатками та державними контрактами здійснюється шляхом спрямування бюджетних коштів виконавцям робіт, надавачам товарів і послуг (крім нерезидентів) на небюджетні рахунки, відкриті на їх ім’я в органах Казначейства у встановленому законодавством порядку, з подальшим використанням зазначених коштів виконавцями робіт, надавачами товарів і послуг виключно з таких рахунків на цілі, визначені договорами про закупівлю товарів, робіт і послуг.
Керуючись вищевикладеним, Сторони домовилися внести відповідні зміни до Договору та викласти реквізити «Підрядника», що містяться в Розділі 19. МІСЦЕ ЗНАХОДЖЕННЯ ТА БАНКІВСЬКІ РЕКВІЗИТИ СТОРІН у наступній редакції:

ПДВ 3 942 333,33 грн. (три мільйони дев’ятсот сорок дві тисячі триста тридцять три грн. 33 коп.), сума Договору в 2020 році зменшилась на 62 620 000 (шістдесят два мільйони шістсот двадцять тисяч грн. 00 коп.);
- на підставі п. 10.2. Договору внести зміни до Додатку № 3 – «План фінансування робіт» до Договору, який являється невід'ємною його частиною.
