Changing the conditions in relation to extension of the contract period, which is sufficient for the procurement procedure at the beginning of next year, to the volume that it does not exceed 20% of the amount specified in the contract, drawn up in the previous year, if these spending approved in the prescribed manner

1. На підставі пункту 8 частини 5 статті 41 Закону України «Про публічні закупівлі» та відповідно до п.13.10 Договору Сторони домовились продовжити дію Договору на строк, достатній для проведення процедури закупівлі на початку 2022 року в обсязі, що не перевищує 20 відсотків суми, визначеної у Договорі та внести зміни до Договору у частині строку дії та викласти абзац 1 пункт 7 Додатку 2 до Договору у наступній редакції: «7. Договір набуває юридичної сили з моменту його підписання Сторонами та діє до 25.02.2022 р.» 2. Всі інші умови Договору, що не змінені цією Додатковою угодою, залишаються без змін. 3. Ця Додаткова угода складена українською мовою у двох примірниках, що мають однакову юридичну силу, - по одному для кожної Сторони. 4. Ця Додаткова угода підписується уповноваженими представниками Сторін, скріплюється печатками Сторін, набуває чинності з дати підписання та є невід’ємною частиною Договору.

З урахуванням необхідності проведення Споживачем процедури відкритих торгів по закупівлі електричної енергії на 2022 рік, керуючись пункту 8 частини 5 статті 41 Закону України «Про публічні закупівлі», Сторони домовились продовжити строк дії Договору до 28 лютого 2022 року, в обсязі, що не перевищує 20 відсотків суми, визначеної в початковому договорі про закупівлю, а саме 154850,00 грн. (сто п’ятдесят чотири тисячі вісімсот п’ятдесят гривень 00 копійок) в т.ч. ПДВ 25808,33грн. Внести зміни до Договору у частині строку дії та викласти в новій редакції абзац 1 пункт 7 Додатку 2 до Договору у наступній редакції: «7. Договір набуває юридичної сили з моменту його підписання Сторонами та діє до 28.02.2022 р.» Внести зміни до пункту 13.1 розділу 13 «Строк дії договору та інші умови», виклавши його в наступній редакції: «Сума, визначена у Договорі (ціна Договору) не може бути більшою 929100,00 грн. (Дев’ятсот двадцять дев’ять тисяч сто гривень 00 копійок), у т.ч. ПДВ 154850,00 грн. (Сто п’ятдесят чотири тисячі вісімсот п’ятдесят гривень 00 копійок).» Видатки на здійснення цієї закупівлі затверджено в установленому порядку. Всі інші умови Договору що не змінені цією Додатковою угодою, залишаються без змін. Ця Додаткова угода складена українською мовою у двох примірниках, що мають однакову юридичну силу, - по одному для кожної Сторони. Ця Додаткова угода підписується уповноваженими представниками Сторін, скріплюється печатками Сторін, набуває чинності з дати підписання та є невід’ємною частиною Договору.
