Тендерним комітетом Покровської міської ради було оголошено закупівлю за процедурою відкритих торгів через електронну систему закупівель «Рrozorro», оголошення про проведення закупівлі № UA-2017-08-15-000830-c, за предметом закупівлі «Будівництво прибудови до адміністративних будівель під центр надання адміністративних послуг на площі Шибанкова, 11 м. Покровськ Донецької області». Переможцем торгів стало підприємство ПП «Донбас Будіндустрія Сервіс». 20 вересня 2017 року з переможцем торгів було укладено договір № 89 на будівництво прибудови до адміністративних будівель під центр надання адміністративних послуг на площі Шибанкова, 11 м. Покровськ Донецької області на суму 33 687 097,71 гривень з ПДВ, При детальному розгляді закупівлі було виявлено технічну помилку. В процесі виконання умов договору виникла необхідність внесення змін у додаток № 1 до договору № 89 яким є договірна ціна, без збільшення та зміни загальної суми Договору. Додатковою угодою № 9 від 26.12.2018 року до Договору № 89, яка була опублікована 27.12.2018 року, при завантаженні сканованого файлу PDF, який містив договірну ціну, помилково був завантажений невірний додаток . ЗУ «Про публічні закупівлі» не містить механізму виправлення технічних помилок, допущених тендерним комітетом при заповненні форм документів у сфері закупівель після оприлюднення відповідної інформації, комітет може прийняти рішення про виправлення таких помилок , шляхом оформлення відповідного протоколу. Ураховуючи вищезазначене та з метою забезпечення прозорості на всіх стадіях закупівель, пропонується тендерному комітету Покровської міської ради прийняти рішення про виправлення технічної помилки, шляхом підписання відповідного протоколу та опублікування чинної та дійсної Договірної ціни додаток 1 до Договору який викладено у наступній редакції (додається).
Враховуючи роз’яснення Міністерства економічного розвитку і торгівлі України від 01.12.2015 року № 3302-05/40086-08 пропонується прийняти рішення про виправлення вищезазначеної технічної (механічної) помилки, допущеної при завантаженні Додатку № 1 до Договору № 89 на закупівлю будівництво прибудови до адміністративних будівель під центр надання адміністративних послуг на площі Шибанкова, 11 м. Покровськ Донецької області за ДК 021:2015: 45210000-2 — (Будівництво будівель) від 20 вересня 2017 року у який було внесено зміни Додатковою угодою № 9 від 26 грудня 2018 року опублікованої 27 грудня 2018 року , шляхом прийняття відповідного рішення тендерним комітетом та опублікувати вірний додаток № 1 (договірна ціна).
Тендерним комітетом вирішено виправити технічні (механічні) помилки, допущені тендерним комітетом при заповненні форми форму повідомлення про внесення змін до договору після їх оприлюднення на веб-порталі Уповноваженого органу шляхом розміщення протоколу засідання тендерного комітету з даного питання та оприлюдненням вірного додатку № 1 до Договору № 89 на закупівлю «Будівництво прибудови до адміністративних будівель під центр надання адміністративних послуг на площі Шибанкова, 11 м.Покровськ Донецької області» за ДК 021:2015: 45210000-2 — Будівництво будівель від 20 вересня 2017 року, який було змінено Додатковою угодою № 9 від 26 грудня 2018 року опублікованої 27 грудня 2018 року на веб-порталі Уповноваженого органу.
