Керуючись п.10.3 Договору, частиною 5 статті 36 Закону України «Про публічні закупівлі» від 25.12.2015 № 922-VIIІ відповідно до якої дія договору про закупівлю може продовжуватися на строк, достатній для проведення процедури закупівлі на початку наступного року, в обсязі, що не перевищує 20% суми, визначеної в договорі, укладеному в попередньому році, якщо видатки на цю мету затверджено в установленому порядку, а також згідно з частиною 1 статті 23 Бюджетного кодексу України, відповідно до якої будь-які бюджетні зобов’язання та платежі з бюджету здійснюються лише за наявності відповідного бюджетного призначення, якщо інше не передбачено законом про Державний бюджет України.
