Керуючись законодавством України, Сторони дійшли згоди продовжити дію Договору на строк, достатній для проведення процедури закупівлі послуг з постачання газу на початку 2018 року, в обсязі 6 161 703,02 грн. (шість мільйонів сто шістдесят одна тисяча сімсот три грн. 02 коп.), що не перевищує 20 відсотків суми, визначеної в Договорі 30 808 515,10 грн. (тридцять мільйонів вісімсот вісім тисяч п’ятсот п’ятнадцять грн. 10 коп.), в тому числі ПДВ – 5 134 752,52 (п’ять мільйонів сто тридцять чотири тисячі сімсот п’ятдесят дві грн. 52 коп.), укладеному у 2017 році. У зв’язку з цим Сторони погодилися змінити наступні умови Договору: 1. Пункт 10.1. Договору викласти в наступній редакції: «Договір набирає чинності з дати його підписання та укладається на строк до 30 квітня 2018 року, а в частині проведення розрахунків до повного виконання Сторонами своїх зобов`язань за цим Договором. Згідно ст. 631 Цивільного кодексу України умови цього Договору можуть застосовуватися до відносин між Сторонами, які виникли до його укладення.». 2. Дана Додаткова угода набирає чинності з моменту підписання її обома Сторонами та є невід’ємною частиною Договору. 3. Дану Додаткову угоду викладено українською мовою у двох оригінальних примірниках, які мають однакову юридичну силу, по одному для кожної із Сторін.
