У зв’язку зі зростанням ціни на електричну енергію на ринку, що підтверджується експертним висновком Черкаської торгово-промислової палати від 19.09.2022 року № О-348, керуючись статтею 188 Господарського кодексу України, статтями 651, 652, 653, 654 Цивільного кодексу України, п. 2 ч. 5 ст. 41 Закону України «Про публічні закупівлі», дійшли взаємної згоди укласти цю додаткову угоду до Договору № 20.06.2022-1Е від 20 червня 2022 року ( далі – Договір) про наступне:
1. Вирішили збільшити з 01.10.2022 року ціну за одиницю товару до 5,574588 грн. з ПДВ (4,64549 грн. без ПДВ).
2. Викласти пункт 2.3 Договору у наступній редакції: «Очікуваний обсяг постачання електричної енергії на період з 20.06.2022 по 31.12.2022р. становить 1 392 748,666 кВт*год та відповідає очікуваному обсягу закупівлі послуг».
3. Пункт 1. Додатку 2 Договору викласти в наступній редакції:
«1. Ціна (тариф) електричної енергії, у тому числі диференційовані ціни (тарифи): 5,574588 грн. (П’ять гривень 574588 копійок).»
Пункт 2. Додатку 2 Договору викласти в наступній редакції:
4. «2. Обсяг споживання електричної енергії: 1 392 748,666 кВт*год.»
5. Відповідно до п.3 ст.631 Цивільного кодексу України Сторони встановили, що умови пп.1-4 цієї Додаткової угоди застосовуються до правовідносин, що виникли між ними з 20.06.2022.
