Сторони усвідомлюючи та враховуючи, що будь-які доповнення, зміни до договору дійсні і мають юридичну силу, якщо вони здійснені в письмовій формі і підписані уповноваженими представниками сторін та є невід’ємною частиною договору, досягнуто домовленості щодо внесення змін до Договору щодо виправлення помилки в назві Покупця.
Враховуючи вищевикладене викласти абзац 1 Договору а наступній редакції:
«Міське комунальне унітарне підприємство „Міськсвітло” (надалі – Покупець), в особі директора Кондрацького В.О., що діє на підставі Статуту, з однієї сторони і Товариство з обмеженою відповідальністю „Нафтогруппа -2005” ( надалі - Постачальник), в особі директора Соя Сергія Олексійовича, що діє на підставі Статуту, з другої сторони, які разом у подальшому іменуються Сторони, а кожна окремо – Сторона, уклали дану Додаткову угоду до Договору поставки №2986 від 24.02.2017р.(укладеного за результатом проведення публічної закупівлі код 09130000-9 «Нафта і дистиляти» (бензин автомобільний А-95, дизельне паливо), згідно до вимог Закону України „Про публічні закупівлі” від 25.12.2015 № 922-VІІІ) про наступне»

Керуючись пп.2 частини четвертої статті 36 Закону України „Про публічні закупівлі” від 25.12.2015 № 922-VІІІ та пп2 п.12.6 Договору № 2986 від 24.02.2017 року, «… у зв’язку зі зміною ціни за одиницю товару не більше ніж на 10% у разі коливання ціни такого товару на ринку» (згідно листа Постачальника №44 від 25.09.2017р. та експертного висновку Вінницької Торгово-промислової палати В-476 від 08.09.2017р)-Сторони домовились встановити з 25 вересня 2017р. ціну за 1 літр палива рідинного у розмірах:
– на бензин А-95 - 24,40 грн.,
– на дизельне паливо - 21,90 грн.
