На підставі пп. 4 п.19 Постанови Кабінет Міністрів України від 12 жовтня 2022 р. № 1178 «Про затвердження особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України “Про публічні закупівлі”, на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування», у зв’язку з фактичним об’ємом виконання робіт, за сумісним рішенням Сторін (ст. 651 ЦК України) «подовженням строків виконання підрядних робіт та перенесення фінансування на 2025 рік, Сторони домовились внести зміни та викласти в новій редакції п.3.5 Договору, а саме:
1.1. «3.5. Платник проводить виплати за виконані «Підрядником» роботи, на підставі оформленого підписами і печатками "Замовника", "Підрядника" та представника технагляду акту приймання виконаних будівельних робіт (ф №КБ-2в) і довідки про вартість виконаних будівельних робіт (ф. №КБ-3)"
Фінансування здійснюється за рахунок коштів місцевого бюджету згідно з планом фінансування, що є невідємною частиною договору(додаток2) та оплата за роками становит:Загальна вартість наданих Послуг за цим Договором за роками становить:
на 2024 рік – 4313440,76 грн.;
на 2025 рік – 826925,28 грн.»
Сторони за взаємною згодою вирішили викласти Додаток №1 "Календарний графік виконання робіт" та Додаток №2 "План фінансування об'єкту"до Договору в новій редакції.
3.1. «10.5. Цей Договір набирає чинності з дати його підписання Сторонами та діє до 31.12.2025р.
