В зв’язку з необхідністю внесення змін до банківських реквізитів Учасника Сторони дійшли згоди внести зміни до договору від 03.01.2020 № 4/20
Відповідно до Закону України «Про публічні закупівлі» Замовник самостійно через авторизовані електронні майданчики оприлюднює на веб-порталі Уповноваженого органу в порядку. встановленому Уповноваженим органом та цим Законом, повідомлення про внесення змін до договору протягом трьох днів з дня внесення змін. Тобто в Законі не визначено, що повідомлення про внесення змін публікується тільки щодо істотних умов договору. Таким чином, внесення змін до Договору у зв’язку зі зміною розрахункових рахунків необхідно також оприлюднювати через авторизований електронний майданчик. Але при заповненні на майданчику форми цього повідомлення у п.11 «Тип причин додання змін» необхідно вибрати випадок, з тих, що передбачені ч. 4 ст. 36 Закону України «Про публічні закупівлі», а якщо не вибрати один із пункт - система не дозволить оприлюднити зміни. Статтею 36 Закону України «Про публічні закупівлі» передбачені лише зміни істотних умов договору, або зміни в зв’язку з його продовженням на початку наступного року, але жодна з цих змін «не підходить» у разі зміни реквізитів Замовника або Виконавця (Постачальника).
Враховуючи викладене, та з метою своєчасного оприлюднення змін до Договору, під час заповнення форми повідомлення на авторизованому майданчику обрано пункт «ЗМІНА СТОРОННІХ ПОКАЗНИКІВ».
