Extension of the contract term and fulfillment of obligations for transfer of goods, performance of works, provision of services in case of occurrence of documented objectively justified circumstances that caused such extension, including force majeure, delay in financing of customer's expenses, provided that such changes will not lead to an increase in the amount specified in the contract

Державна установа «Темнівська виправна колонія (№100)» має річну потребу в електричній енергії в обсязі 4 385 964 кВт. На фінансування зазначеної закупівлі передбачені кошти в сумі 5 098 156 грн. 54 коп на рік. Для проведення зазначеної закупівлі нами було оголошено проведення переговорної процедури закупівлі на електронному майданчику, який входить до системи Прозоро. Під час публікації повідомлення про намір укласти договір виникла технічна помилка: зазначено термін постачання електричної енергії: «до 31.01.2017» замість «31.12.2017». Аналогічна технічна помилка була допущена і в договорі (п.3.1.), де зазначено, що ціна договору становить 5 098 156 грн. 54 копійок на період «по 31.01.2017» замість «31.12.2017». Зазначені неточності можливо виправити шляхом внесення змін до договору відповідно до пункту 4 частини 4 статті 36 Закону України «Про публічні закупівлі»: «Продовження строку дії договору та виконання зобов’язань щодо передання товару, виконання робіт, надання послуг у разі виникнення документально підтверджених об’єктивних обставин, що спричинили таке продовження, у тому числі непереборної сили, затримки фінансування витрат замовника, за умови, що такі зміни не призведуть до збільшення суми, визначеної в договорі». Документальним підтвердженням викладеного є: - річний план закупівель на 2017 рік; - протокол засідання тендерного комітету щодо організації проведення процедури закупівлі, протокол переговорів, - протокол засідання тендерного комітету від 10.01.2017 про намір укласти договір, оприлюднений на елеронній площадці «Прозоро».
