Предмет закупівлі підпадає під виключення, так як фінансується відповідно до Фінансової угоди між Україною та Європейським інвестиційним банком в рамках реалізації проекту "Надзвичайна кредитна програма для відновлення України". Порядок заключення і виконання договору встановлено відповідно до Посібника із закупівель для проектів, що фінансуються Європейським інвестиційним банком. Стаття 6 ЗУ «Про публічні закупівлі» передбачає,що закупівля робіт за рахунок позики Європейського інвестиційного банку здійснюється згідно з правилами і процедурами, встановленими цією організацією.
