У відповідності до умов Договору, керуючись пп.7 п.5 ст.41 Закону України "Про публічні закупівлі" від 25.12.2015 року №922-VIII, а саме через зміну тарифу на передачу електричної енергії НЕК "Укренерго" (Постанова НКРЕКП від 09.12.2020 р. №2353), що є регульованою ціною(тарифом) і застосовується в договорі про закупівлю, і не залежить від волевиявлення Постачальника, сторони домовились внести зміни до Договору в частині узгодженої зміни ціни в бік збільшення пропорційно зміненій ціни частини складової.
