Оскільки, Постачальник надіслав Споживачу повідомлення № 12/09-02 від 12.09.2022 року в якому зазначив, що у зв’язку із невиконанням/неналежним виконанням недобросовісними споживачами Товариства умов договорів про постачання електричної енергії, в частині своєчасної
та у повному обсязі сплати за спожиту електричну енергію, до ціни якої аналогічно включено також вартість тарифу на Послугу, оператором системи передачі ПрАТ “НЕК “Укренерго” (надалі - ОСП) віднесено Постачальника до списку учасників ринку електричної енергії, яким надано статус “Переддефолтний”, а з 12.09.2022 р. - “Дефолтний”, та вказане позбавляє Постачальника можливості здійснювати закупівлю та продаж/постачання електричної енергії споживачам, і повідомив Споживача про припинення постачання електричної енергії з 23:59 “11” вересня 2022 року, Сторони вирішили достроково розірвати Договір № 38 від 31.01.2022 року в частині постачання електроенергії з 12.09.2022 року
