Виникнення надзвичайних, невідворотних та об’єктивних обставин, що підтверджені листом Торгово-промислової палати України від 28.02.2022 № 2024/02.0-7.1, а саме військовою агресією російської федерації проти України, що стало підставою введення воєнного стану із 05 години 30 хвилин 24.02.2022 відповідно до Указу Президента України від 24.02.2022 № 64/2022 «Про введення воєнного стану в Україні» (зі змінами) та Закону України "Про затвердження Указу Президента України "Про продовження строку дії воєнного стану в Україні" від 08.11.2023 № 3429-IX, а також відсутність достатнього фінансування Проєкту «Підвищення енергоефективності громадських будівель у м. Кременчук» (надалі – Проєкт) Європейським Банком Реконструкції та Розвитку унеможливлює своєчасне виконання робіт по Проєкту. Сторони, керуючись умовами та положеннями даного Договору та пунктом 4 частини 5 статті 41 Закону України «Про публічні закупівлі» домовились продовжити термін дії даного Договору до 31 грудня 2024 року, що є достатнім для надання послуг з технічного нагляду за роботами на об’єктах Проєкту в повному обсязі. Зазначені зміни до договору оформлені підписанням додаткової угоди.
