Керуючись п.2 ч.4 ст.36 Закону України "Про публічні закупівлі" Сторони домовились збільшити ціну за одиницю товару - 27,60 грн. за один літр бензину А-95, 26,88 грн. за один літр дизельного палива, не більше ніж на 10 відсотків у зв'язку із коливанням ціни такого товару на ринку, та без збільшення загальної вартості договору. У разі зміни договору зобов'язання сторін змінюються відповідно до змінених умов щодо предмета, місця, строків виконання тощо. У зв'язку із застосуванням п.1 цієї додаткової угоди сторони домовились викласти п. 1.2., 3.3, договору та специфікацію з додатку №1 до договору в новій редакції
