Change of conditions due to extension of the contract term, sufficient for conducting procurement procedure at the beginning of the next year, in the amount not exceeding 20% of the amount specified in the contract made in the previous year, if expenses for these purposes are approved in the established order
Note:
Керуючись частиною 5 статті 36 Закону України "Про публічні закупівлі" (у редакції, що діяла на момент проведення процедури закупівлі), та у відповідності з пунктами 11.2., 11.4. даного Договору, Сторони погодились продовжити строк дії Договору на строк, достатній для проведення процедури закупівлі на початку наступного року в обсязі, що не перевищує 20 відсотків суми, визначеної в Договорі, укладеному в попередньому році, та викласти наступні пункти Договору у новій редакції:
“5.1. Сума цього Договору становить: 227 070,00 грн. (двісті двадцять сім тисяч сімдесят гривень, 00 копійок) з урахуванням ПДВ, у тому числі ПДВ: 37 845,00 грн. (тридцять сім тисяч вісімсот сорок п’ять гривень, 00 копійок); 189 225,00 грн. (сто вісімдесят дев’ять тисяч двісті двадцять п’ять гривень, 00 копійок) без урахування ПДВ.”; та складається з:
- за період дії з 10.01.2020 р. до 31.12.2020 р.: 189 270,00 грн. (сто вісімдесят дев’ять тисяч двісті сімдесят гривень, 00 копійок) з урахуванням ПДВ;
- на період дії з 01.01.2021 р. по 31.03.2021 р.: 37 800,00 грн. (тридцять сім тисяч вісімсот гривень, 00 копійок) з урахуванням ПДВ.
“11.1. Даний Договір набирає чинності з дати підписання та діє по 31 березня 2021 року включно (або до укладання замовником договору за результатами нової процедури закупівлі), але в будь якому разі до повного виконання Сторонами своїх невиконаних зобов’язань за Договором.”
2. У зв’язку зі змінами, враховуючи фактичні обсяги закупівлі у 2020 році та визначені заплановані обсяги закупівлі на 2021 рік, Сторони погодились викласти в новій редакції Специфікації до Договору, які є невід’ємними Додатками до цієї Додаткової угоди та Договору.
