Extension of the contract term and fulfillment of obligations for transfer of goods, performance of works, provision of services in case of occurrence of documented objectively justified circumstances that caused such extension, including force majeure, delay in financing of customer's expenses, provided that such changes will not lead to an increase in the amount specified in the contract
Note:
1. Викласти п.2.2. Розділу 2. «Вартість робіт та порядок розрахунку» даного Договору у наступній редакції та доповнити п. 2.3.:
«2. Вартість робіт та порядок розрахунків
2.2. Вартість робіт до виконання на 2022 рік становить 288000 грн. 56 коп.(Двісті вісімдесят вісім тисяч гривень 56 копійок) без ПДВ та будуть сплачені згідно умов договору Замовником.
2.3. Передбачене фінансування виконання робіт на 2023 рік становить 3011998 грн. 44 коп. ( Три мільйони одинадцять тисяч дев’ятсот дев’яносто вісім гривень 44 копійки) без ПДВ.»
2. Відповідно до змін, зазначених в даній Додатковій угоді №4, а саме в пунктах 2.2. та 2.3. Розділу 2 викласти в новій редакції п. 6.5. Розділу 6 «Розрахунки та платежі»:
«6.5. Всі розрахунки здійснюються при умові наявності коштів на рахунку замовника. Передбачені терміни фінансування робіт наведені в пунктах 2.2. та 2.3.»
3. Внести зміни до пункту 3.1. Розділу 3. «Терміни виконання робіт» даного Договору та викласти його у наступній редакції:
«3. Терміни виконання робіт
3.1. Роботи по Договору розпочинаються після отримання Замовником повідомлення (дозволу) на виконання будівельних робіт і повинні бути виконані Виконавцем до 01 червня 2023 року, що визначається в Графіку до даного Договору.»
4. Відповідно до змін, зазначених в даній Додатковій угоді №4, викласти в новій редакції Додаток №1 «Графік виконання робіт» (додається) до даного Договору.
5. Внести зміни до пункту 11.1. Розділу 11. «Термін дії договору та інші умови» Договору №557 та викласти його у наступній редакції:
«11.1. Даний Договір вступає в силу з моменту підписання і діє до 31.12.2023 р., але в будь-якому разі до повного виконання Сторонами прийнятих на себе зобов’язань.»
