Слід зауважити, що Договір, укладений відповідно до Постанови № 169 за спрощеною закупівлею, не є договором у розумінні Закону, а є договором у розумінні Цивільного кодексу та Господарського кодексу. Отже, на такий договір не поширюються обмеження, встановлені статтею 41 Закону, тим паче що таке збільшення обслуговуваних транспортних засобів не призводить до збільшення суми, визначеної в договорі про закупівлю.
