Керуючись п.7, ч.5, ст.41 Закону України "Про публічні закупівлі", Сторони дійшли згоди збільшити суму Договору на 191 394,32 грн (сто дев'яносто одна тисяча триста дев'яносто чотири гривні 32 коп.) та внести зміни до абзацу 3 пункту 40 розділу "Розрахунки за користування Т/Е" Договору, виклавши його в наступній редакції: "Сума договору згідно діючих тарифів складає 847 827 грн 38 коп. з ПДВ (вісімсот сорок сім тисяч вісімсот двадцять сім гривень 38 коп.)".

Відповідно до ч. 6 ст. 41 Закону, для проведення процедури закупівлі на початок 2022 року, Сторони дійшли згоди продовжити термін дії Договору №5324 "С" про закупівлю теплової енергії у вигляді гарячої води за державні кошти від 13.04.2021 та внести зміни до п.51 розділу "Термін дії Договору" виклавши його в наступній редакції: "п. 51. Договір набуває чинності з дати підписання уповноваженими представниками Сторін та скріплення їх підписів печатками Сторін, поширює дію на відносини, що фактично склалися між Сторонами 01.04.2021 і діє в частині постачання Т/Е (опалення) та надання послуги з централізованого постачання гарячої води по 28.02.2022 (згідно ч.3 ст 631 Цивільного Кодексу України), а в частині розрахунків - до їх повного здійснення".

Сума Договору згідно діючих тарифів збільшується на 169 565 грн 48 коп. і складає 1 017 392 грн 86 коп. з ПДВ.

У зв’язку з підписання Додаткової угоди №8 з з ПОКВПТГ «Полтаватеплоенерго» про припинення дії Договору № 5324 "С" від 13.04.2021 року з 01.01.2022 року, Додаткова угода №7 втратила свою юридичну чинність, так як була підписана 18.01.2022 року. А отже, сума Договору змінюється і становить 847 827,38 (вісімсот сорок сім тисяч вісімсот двадцять сім грн 38 коп.), як було погоджено в Додатковій угоді №5 від 09.12.2021 року.
