Відповідно до п. 5 ст. 41 Закону України «Про публічні закупівлі», та п. 3.12. договору № 94 від 21.02.2022р у зв’язку зі значним зростанням ціни на закупівлю відповідно до експертного висновку з Чернігівської регіональної торгово-промислової палати №ЧК-316 від 15.09.2022року (копія додається), що підтверджено протоколом уповноваженої особи від «23»09.2022р. № 645 Сторони внесли зміни, збільшили ціну товару на йогурт жирністю 2,5%, кефір жирністю 2,5%, сметану жирністю 15 % не більше ніж на 10%. Ціна постачальника на йогурт жирністю 2,5% становить – 59,40 грн./кг з ПДВ., кефір жирністю 2,5% становить – 37,80 грн./кг з ПДВ., сметану жирністю 15 % становить – 94,56 грн./кг з ПДВ.

На підставі п. 3.13 договору № 94 від 21.02.2022 та з дотриманням пункту 6 статті 41 Закону України «Про публічні закупівлі» вирішили укласти цю додаткову угоду до договору про закупівлю товарів за державні кошти № 94 від 21.02.2022 про наступне: 1. Сума додаткової угоди становить 60000,00 грн. (шістдесят тисяч грн. 00 коп.) з урахуванням ПДВ ( Спеціальний фонд: КПКВ 4111010 – 60000,00 грн.), що не перевищує 20 відсотків суми визначеної у договорі про закупівлю укладеному у попередньому році з урахуванням всіх додаткових угод.
