У зв’язку з відсутністю конкуренції (у тому числі з технічних причин) на відповідному ринку, внаслідок чого договір (або додаткова угода) про закупівлю може бути укладено лише з одним постачальником, за відсутності при цьому альтернативи керуючись положенням абз. 3 п. 2 ч. 2 статті 40 Закону України "Про публічні закупівлі". Згідно Закону України «Про природні монополії» природна монополія – стан товарного ринку, при якому задоволення попиту на цьому ринку є більш ефективним за умови відсутності конкуренції внаслідок технологічних особливостей виробництва. Суб’єкт природної монополії – суб’єкт господарювання(юридична особа) будь-якої форми власності, який виробляє (реалізує) товари на ринку, що перебуває у стані природної монополії. Відповідно до ч. 2 ст. 5 Закону України «Про природні монополії» визначено, що зведений перелік суб’єктів природних монополій ведеться Антимонопольним комітетом України. Зведений перелік суб’єктів природних монополій розміщується на офіційному веб-порталі Антимонопольного комітету України (www.amc.gov.ua ). Станом на 30.11.2020, АТ «ОДЕСАГАЗ»» внесено до Реєстру суб’єктів природних монополій, які провадять господарську діяльність у сфері розподілу природного газу, за видом господарської діяльності, що проводиться суб’єктом господарювання – розподіл природного газу та здійснює свою господарську діяльність на території Одеської області відповідно до діючої ліцензії на розподіл природного газу та згідно затверджених тарифів щодо надання послуг з розподілу природного газу на території Одеської області. Частиною другою статті 5 Закону України «Про природні монополії» передбачено, що перелік суб'єктів природних монополій складається та ведеться Антимонопольним комітетом України (далі також – АМКУ) відповідно до його повноважень. За даними офіційного веб-сайту АМКУ (www.amc.gov.ua.), Акціонерне товариство «Одесагаз», внесено до Зведеного переліку суб’єктів природних монополій.
