Note:
Керуючись вимогами Цивільного кодексу України, Господарського кодексу України, Закону України «Про ринок електричної енергії», Правил роздрібного ринку електричної енергії, затверджених постановою Національної комісії, що здійснює державне регулювання у сферах енергетики та комунальних послуг від 14 березня 2018 року № 312 (зі змінами), а також Закону України «Про публічні закупівлі», уклали цю Додаткову угоду до Договору про постачання електричної енергії споживачу (далі – Договір) про наступне:
1. Сторони, враховуючи те, що підстави для зміни істотних умов Договору визначаються Додатком 3 до Договору та нормами чинного законодавства України, зокрема статтею 651 Цивільного кодексу України, статтею 188 Господарського кодексу України, пунктом 3 частини п’ятої статті 41 Закону України «Про публічні закупівлі» домовились про покращення якості предмета закупівлі, за умови що таке покращення не призведе до збільшення суми, визначеної в договорі про закупівлю в частині уточнення та доповнення банківських реквізитів замовника.
2. Відповідно до вимог Закону України «Про публічні закупівлі» та пункту 11.11 Договору, з метою покращення якості предмета закупівлі, а саме в частині розрахунків, Сторони погодилися викласти банківські реквізити Споживача в наступній редакції:

3. Зобов’язання Сторін та умови, передбачені Договором та не обумовлені цією Додатковою угодою, залишаються без змін.
4. Ця Додаткова угода є невід’ємною частиною Договору, укладена українською мовою у двох оригінальних примірниках.
5. Ця Додаткова угода набирає чинності з дня її укладення та діє до 31.12.2021 року.

1.У зв'язку зі збільшенням ціни за електричну енергію на ринку електричної енергії Сторони установили, що з 01.07.2021 року ціна електричної енергії за Договором становить : 2,464524 грн. за 1 кВт*год., в тому числі: нерегульована частина ціни 1,75984 грн. за 1кВт*год без урахування ПДВ; регульований тариф на послуги з передачі та розподілу електричної енергії 0,29393 грн. за 1кВт*год без урахування ПДВ; ПДВ-0,410754 грн.
2.У зв'язку зі зміною ціни за одиницю товару Сторони погодили, що кількість товару (обсяги постачання електричної енергії) становить 307690,19 кВт*год.
3.Додаток 2 "Комерційна пропозиція" викласти в новій редакції.
